I just received an 3 year h1-B extension based on an approved I-140. I had only 2 years left of 6 year h1 limit but because I have an approved I-140, I got one more year.
I attached my approved I-140 copies along with H1B extension application but the Alien number A# on this new H1-B extension approval is different than what I have on I-140 approval notice. Actually its a typo, instead of A 08 it A 008 and because of one extra zero the last digit is lost.
Is this a matter of concern? Please help.

I am working on H1b visa and changed job mid of last year. I got my H1B visa and stamping and is valid till September 2010 . Now I changed my job and has another H1b visa and I 94 which is valid till 2012.
I am going to Canada to get Visa stamped and want to know if I will be allowed to come back to US even if my request gets denied.
And what will happen to my old visa ?

I do not think so. I believe these are two separate issues and should not have any effect on the chances of your frnd securing visa.

Speaker Nancy Pelosi's House quickly passed the Democrats' popular campaign promises, including measures on the minimum wage, stem cell research, renewable energy and reforms of the student loan and Medicare prescription drug programs.
This agenda had its skeptics, but it provided focus for a party long out of power and drew significant Republican defections, feeding a raft of "Republicans in Disarray" stories. Pelosi noted at a January news conference that so many Republicans voted for the Democratic proposals that one of her colleagues joked: "Maybe you made these bills too easy."
The Senate Democrats quickly pushed through a different version of the minimum-wage increase, and the party's leading foreign policy voices framed a critique of President Bush's Iraq policy that squared with the public's increasingly skeptical view of the war.
But recent weeks have held nothing but trouble for Democrats -- and it is odd, as one Democrat noted, that they should be on the defensive when the scandal over the treatment of wounded veterans at Walter Reed Army Medical Center has focused attention on yet another failed aspect of the administration's execution of the war and its aftermath.
Instead, one news story after another has highlighted differences among congressional Democrats over how to end the war. There is also the divide between the Washington party and activists at the grass roots and in the blogosphere. All of these problems are rooted in two unalterable facts: Democrats, on the basis of their thin majorities in Congress, lack the numbers to force an unwilling president to alter his course. And they are short of votes to cut off funds for the war altogether.

Dems are not united on most issues.
Although this article is on Iraq, a similar situation will occur on Immigration. The big difference is that Dems are very interested in Iraq (they won elections on Iraq) whereas I haven't seen much much Democratic interest on Immigration.

I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?

If your parents never overstayed beyond their I-94 date then I do not think there is any issue at all. POE off. can ask why you are coming again in 3 months then they can tell that they want to be here in new year time etc.

Hi,
When u use EAD and AP to come back into US, then u loose your H1 status.
About reverting back to H1 from EAD, there are many Ifs and buts. You should have a valid H1 maintained etc. Consult a good attorney.

You should change to H-4 (assuming you are eligible) if you are not working. You should be able to change back H-1B later and get the remainder of your 6 years, without being subject to the cap, if you find a new employer. It is important not to violate status now, and not working violates your H-1 status even if the lack of work is not your choice.

I applied AP around same time and got it couple of days ago.
Check not cashed is indication of missing mail, either by mailing services (USPS, FEDEX, ...) or in USCIS. Average time for check to be cashed is less than 10 days.
Whether you should open SR or re-apply, someone who faced similar situation can provide better answer.

I was told by my lawyer that I am eligible for the 245i and we are getting the paper work together. Here is my story:
My aunt filed for the i 130 in May 18,1994 for my mum (aunt's sister and her family). It was approved in the same year. While waiting for the priority date I aged out. I was in the US on a F1 visa and went out of status. We consulted many lawyers and the one we retained told me that we can apply for an F1 visa from a i 20 I had got from a school and we filled the paperwork and waited for over a year and half before it was denied. Then the lawyer told me I can apply for AOS through the 245i. We are going to apply for i 130 next month. I am getting ready to pay another retainer to the same lawyer and invest a decade in this process. I would appreciate any information.

I sent my application to vermont based on the USCIS answering system on June 30th that folks with approved I-140s should send 485 applications to the center where it was approved. Any ideas, if there is a problem with that and if the app gets transferred how much time it will take.

Anyone following the cap count would see that H1B numbers have gone down from 45500 to 44400 in one week. Since obviously even if no one submitted an H1B applicn last week, the only way numbers could have gone down is if USCIS denied 1100 applications. Seems like a high number of rejections in one week. My guess is these numbers reflect the the RFE(impossible to reply RFEs) cases that were sent to the premium processing and a few regular processing cases that ran out their time limit and got denied. It will be funny( for the anti immigrants) to see if the Cap count numbers continue to go down and guess by sept 2010, the numbers still available in the quota would be around 60k?!?
Just another example of the ruthless and cold hearted stand that USCIS is taking towards highly* skilled immigrants.
